First sign of it is activity at Villa Barone construction site.
But this is not, what we expected.
According to Notice of Violation issued by Building Department on October 3, 2007:

Villa Barone was ordered to remove constructed waterfall and water lines as well as to backfill chamber in the retaining wall. Until this time none has been done.
Instead another amended site plan is filed with Planning Board to approve what was illegally built.

Haw can this Town consider any application regarding this property while Building Department order is not executed yet?

Today I visited Town to find why, boards accepting applications from Villa Barone, if they have not rectified violation yet.

Peggy Moore told me that she doesn’t know about Notice of Violation.

When I call town attorney Greg Folchetti he stated: “I don’t want to be involved in this case”  ???????

Continuation:

During my conversation with Mr. Folchetti, he advised me to contact Anthony Mole.

But, Mr. Mole was in the firm Curtiss, Leibell & Shilling.

 Mr. Shilling represents the Creccos (DBA Villa Barone). This is a conflict!
Same time:
ZBA Decision & Order which includes Stipulation of Settlement specifically provides:

“Applicant agrees to complete only the construction detailed on an initialed Site Plan Full Layout as modified herein.
A copy of Site Plan Full Layout has been initialed this date by the parties, and applicant, its successors and/or assigns will not conduct any other development of the applicant’s property for five years from the date of this agreement.”

1. Thank to Mr. Gregory Folchetti for mentioning legal issues regarding Villa Barone.

2. Carmel Water District #13 Rolling Greens it is extension to #10 Lakeview Park
and #8 Mahopac Ridge.

Why Mr. Ravallo ask   only about Rolling Greens?

Planning:

1. Thank to Town Planner Mr. Patrick Cleary for asking applicant for details.

One detail: top of almost 3 story high waterfall trough is within 79ft from my master
bedroom.


2. Mr. Shilling strongly supported by Mr. Greenberg and Vice Chairman of Planning Board Emma Kounine
Stated that illegal build waterfall is (in my understanding) accidently built, and this is not any other development.

He forgets about part of Stipulation:

5. Nothing contained in this Stipulation of Settlement, including but not limited to the location of retaining walls, is intended to, or shall, enlarge or diminish the scope of the variances heretofore granted by the Town of Carmel Zoning Board of Appeals. The location of retaining walls is for the purposes of screening and lateral support only.

April 17 preparation for construction on east side of Villa Barone parking lot (installing wood fence to screen construction)

April18 -    May 9 construction in progress (excavating …, earth moving…, footing forms and reinforcing rods installation)

May 7 construction in progress during 2008 Shop Putnam Expo  

May 12 in the morning I have applied to review files regarding construction in progress  (immediately excavator has been removed)

This construction is located between parcel #75.16-1-17 Villa Barone Hilltop Manor
And #75.16-1-16 Hilltop Manor Realty Corp, D.B.A. Cliffside Property Management

May 16 response  from Michael Carnazza,  Building Department to my F.O.I.L. request:

Simply question

How construction can be ongoing at the site without filed plans, and not corrected previous violation?

What our Town  intends to do?

What Mr. Carr, and Mr. & Mrs. Monaco need to do is to follow the commonly accepted rules and procedures for obtaining a variance in our town.  Just have Councilman Ravallo hand deliver a letter stating the true intent of the Town Board at the time  the ordinance was crafted.  Oh,.. and have Kelly Primavera and some other former councilman sign off.  You can probably reach Mr. Pozzi at Dave Furfaro's place.  Surely, the final height of the fence falls under the and/or exemption that worked for Mr Leibell with his senior housing.

If, for some strange reason, that doesn't do the trick, point to the Massaro house out there on the lake.  How did that one happen without any DEP or DEC permits ?

Mr. Fraser, I sympathize, I really do.  I know that you're just trying to hold the line.  But please don't pretend that all of the nonsense ended in the 70's.  Any and all residents that have been denied permits or have been cited for violations can (and should) be allowed to reference the absolute hypocrisies of past board rulings.

And folks, when you finally do re-apply for those permits, make sure to tell Ms. Moore  that you'd like to pay the application fee in six installments.
